1. Legal seller — who you are contracting with
Legal Seller: Pedro Neves, trading as SwimWise AI.
SwimWise AI is the trading name under which the services described in these terms are provided, and is the public-facing brand and product name. The legal seller and provider of the Service is Pedro Neves, trading as SwimWise AI ("we", "us", "our"), operating from the United Kingdom. These terms form a contract between you and Pedro Neves, trading as SwimWise AI, in respect of the SwimWise AI lesson planning service available at swimwise.dev (the "Service").
Paddle.com is the Merchant of Record for all subscription payments. Customers purchase subscriptions from Paddle, acting as Merchant of Record, and Paddle appears as the seller on your payment statement and invoice (see section 10).

2. Acceptance
By creating an account, subscribing, or continuing to use the Service you agree to these terms. If you are using the Service on behalf of a swim school or other organisation, you confirm you have authority to bind that organisation. If you are using it as an individual, you confirm you are of legal age to enter a contract.
3. The Service
SwimWise AI generates draft swimming lesson plans from the details you provide, aligned to the teaching framework you select. Plans are decision-support material only. You remain the qualified professional responsible for the safety, suitability and delivery of every lesson, and must apply your own judgement and your employer's or governing body's requirements before teaching.
4. Your account
You must provide accurate registration details and keep them up to date. You are responsible for keeping your login credentials confidential and for all activity that takes place under your account.
5. Licence and restrictions
We grant you a limited, non-exclusive, non-transferable right to use the Service within the plan you have selected. You may use generated lesson plans in your own teaching practice. You may not reverse engineer the Service, resell or redistribute access to it, or circumvent usage limits or other technical controls.
6. Acceptable use
You must not misuse the Service. In particular you must not:
- use it for any unlawful purpose, or in breach of safeguarding or child protection obligations;
- commit fraud, send spam, or impersonate another person or organisation;
- infringe the intellectual property or privacy rights of others;
- interfere with the security or integrity of the Service, including introducing malware, probing or penetration testing, automated scraping, or attempting to access other users' data.
7. AI-generated content
The Service uses artificial intelligence to produce lesson content. You are responsible for the descriptions and details you submit, for having the right to submit them (do not include swimmers' personal data you are not permitted to share), and for checking outputs before use. AI outputs can be inaccurate, incomplete or unsuitable for a particular group, and are not a substitute for qualified professional judgement, medical advice, or your national governing body's syllabus. You must not use the Service to generate unlawful, harmful, harassing or infringing content.
We may filter, refuse, restrict or remove content, and may suspend accounts, where content breaches these terms. If you believe content generated or stored on the Service infringes your rights, contact us at support@swimwise.dev and we will investigate and, where appropriate, remove it. Accounts responsible for repeated infringement will be terminated.
8. Intellectual property
We retain all ownership of the Service, including its software, prompts, documentation, design and branding. As between you and us, you keep ownership of the lesson descriptions and content you submit, and you grant us a limited licence to host and process that content solely to provide the Service to you. Framework names and syllabuses referenced in the Service belong to their respective owners; SwimWise AI is an independent tool and is not endorsed by or affiliated with those organisations.
9. Service availability
We work to keep the Service available, but we do not guarantee that it will be uninterrupted, timely, secure or error-free. Features may change over time. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
10. Payment and subscriptions
Subscriptions are billed monthly in GBP at the price shown on our pricing page, and renew automatically until cancelled. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Payment, billing, tax, cancellation and refund mechanics are governed by Paddle's Buyer Terms. See also our Refund Policy. You can cancel at any time and keep access until the end of the paid period.
11. Suspension and termination
We may suspend or terminate access where there is a material breach of these terms, non-payment, a security or fraud risk, or repeated or serious policy violations. You may close your account at any time. On termination your access ends; you may export or download your saved lesson plans before closing your account, and remaining data is deleted or anonymised in line with our Privacy Notice.
12. Liability
To the fullest extent permitted by law, we are not liable for indirect, consequential or special damages, including loss of profits, data or goodwill. Our total aggregate liability arising out of or in connection with the Service is limited to the fees you paid in the twelve months before the claim. Nothing in these terms excludes liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded by law.
13. Indemnity
You will indemnify us against claims arising from the content you submit, your unlawful use of the Service, or your breach of these terms.
14. General
These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction. You may not assign these terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. Neither party is liable for delays caused by events beyond its reasonable control. We may update these terms and will post the revised version here with a new "last updated" date.
